When choosing a project you have to check separately whether that particular project really does meet the TEA requirements. The approval of a project, or its promotional description, does not in itself mean the investment automatically fits the EB-5 requirements.

Do jobs have to be created

Yes. Job creation is one of the programme's main requirements. The investment must lead to the creation of at least 10 qualifying full-time jobs for eligible workers in the United States.

With a direct investment the investor usually has to account for the creation and maintenance of the required jobs themselves. Where the investment is made through a regional centre the structure of the programme can be different, because in certain cases indirect and induced jobs are also counted, in accordance with the programme's rules.

That is exactly why the project's economic model matters enormously when preparing an EB-5 case.

What a Regional Center is

A regional centre is an organisation that takes part in the EB-5 programme and works with investment projects within the corresponding structure. For many investors this can be more convenient than setting up a business themselves. Instead of personally running an enterprise, the investor puts money into an approved project, and job creation is calculated using the methodology provided for by law.

But the involvement of a regional centre does not mean there are no risks. Before investing you have to study the project itself, the financial documents, the company structure, the terms for exiting the investment and the potential risk of losing capital.

How the EB-5 process works

The EB-5 process can be fairly complex and lengthy. It has an investment part, an immigration part and a documentary part. At the first stage the investor chooses a suitable project and analyses where their money came from. After that the investment is made and the immigration paperwork is prepared.

The applicant files the relevant petition with USCIS. Depending on the circumstances and their current immigration status, the rest of the process may take place inside the United States or through consular processing abroad. Can you get a Green Card through the EB-5

Can you live in any state

Once permanent status has been granted, the investor is not tied to the state where the investment project is located. The investment project may be in one state, for example, while the investor actually lives in another.

But where the project is carried out does matter for meeting the programme's requirements, so the investor's place of residence should not be confused with the place where the qualifying investment activity takes place.

Can the investment be recovered

The EB-5 is not an ordinary bank deposit with a guaranteed return of money. Under the programme's requirements the invested capital must be at risk of loss. That means the investor has to assess the project's financial position carefully and understand that obtaining a Green Card should not be treated as a guaranteed financial outcome.

The terms on which capital might be returned depend on the particular project and its investment structure. So promises of guaranteed profit or a guaranteed return of money call for particular caution.

Can you make money on an EB-5 investment

The purpose of the EB-5 is tied above all to immigration requirements, not to maximising investment returns. Some projects provide for a potential return to investors, but it depends on the terms of the particular investment.

When choosing a project it is important to look not only at the expected return but at the likelihood of meeting the immigration requirements, the project's financial stability and the risks to the capital.

The main risks of the EB-5

Attractive as the programme is, the EB-5 is not a guaranteed way of obtaining a Green Card. The main risks relate to the investment project itself, the creation of the required number of jobs, proving the source of the funds and complying with all the immigration requirements.

If the project turns out to be financially unsuccessful, or the programme's necessary conditions are not met, that can affect both the invested capital and the immigration process.

That is exactly why, before putting money in, you have to study not only the project's promotional material but its legal and financial documentation.

The EB-5 and other immigration options

For wealthy foreigners the EB-5 is only one of the possible routes to moving to the United States. Depending on the situation, the EB-1, EB-2, EB-3 and E-2 categories and other options may be worth considering. They differ in their requirements on investment, education, business, employer and professional experience.

The E-2, for example, may be of interest to entrepreneurs from countries that have the relevant treaty with the United States, but it is a non-immigrant category and is not a direct equivalent of the EB-5. So the choice of programme depends on the person's aims: permanent residence, building a business, temporary work or investment activity.

How long the process takes

The exact timescales for the EB-5 can differ considerably. The length of the process is affected by the investor's country of birth, the availability of a visa number, the project chosen, how quickly USCIS processes the documents and other circumstances. For some applicants the process can take several years. So the EB-5 cannot be regarded as a way of moving to the United States quickly.
